General Terms and Conditions Hotel ***Superior Waldhaus Pulsnitz

SCOPE OF APPLICATION

1.

These Terms and Conditions apply to contracts for the rental of hotel rooms for accommodation and other services provided by the hotel (Hotel Accommodation Agreement). 

2.

Subletting or subletting of the rooms provided as well as their use for purposes other than lodging shall require the prior consent of the Hotel in text form.

3.

The customer's General Terms and Conditions of Business shall only apply if this has been expressly agreed in writing in advance.

 

CONCLUSION OF CONTRACT, PARTNERS, STATUTE OF LIMITATIONS

1.

The hotel is free to confirm the room booking in text form. 

2.

The contracting parties are the hotel and the customer. If a third party has placed an order on behalf of the customer, that third party shall be liable to the hotel together with the customer as joint and several debtors. 

3.

All claims against the hotel are generally subject to a limitation period of one year from the start of the statutory limitation period. Claims for damages shall become statute-barred after five years. The limitation periods shall not apply to claims based on a wilful or grossly negligent breach of duty by the hotel.

 

OFFSETTING, PAYMENT, PRICES, SERVICES

1.

The hotel is obliged to keep the rooms booked by the customer ready and to provide the agreed services. 

2.

The customer is obligated to pay the hotel's applicable rates for the room rental and the additional services used by the customer. This shall also apply to services and expenses of the hotel to third parties arranged by the customer. The agreed prices include the respective statutory value added tax. 

3.

The hotel may make its consent to a subsequent reduction in the number of booked rooms, the hotel's services or the customer's length of stay requested by the customer dependent on an increase in the price of the rooms and/or the hotel's other services. 

4.

Invoices of the hotel are payable without deduction within 7 days of the invoice being sent. In the event of late payment, the hotel is entitled to charge a lump sum (late payment surcharge, processing fee) in the amount of 25.00 euros.  

5.

The hotel is entitled to demand advance payment or security from the customer upon conclusion of the contract. 

6.

In justified cases, e.g. the customer is in arrears with payments, the hotel is entitled to refuse further services.

 7.

The customer may only offset or set off an undisputed or legally valid claim against a claim of the hotel.

 

CUSTOMER CANCELLATION (ORDER, CANCELLATION and NoShow)

1.

Any rescission by the customer of the contract concluded with the hotel requires the hotel's consent in text form. If such consent is not given, the agreed price under the contract is payable even if the customer does not make use of contractual services. 

2.

A free right of withdrawal for the customer exists until 7 days before arrival. Within this period a payment in the amount of 50% of the booking price is due, within the last 24 hours before arrival in the amount of 100% of the booking price.

3.

In the case of rooms not used by the customer, the hotel shall credit the income from renting these rooms to other parties. If the rooms are not rented out to other parties, the hotel may charge 100% of the contractually agreed remuneration. 

4.

Any right to withdraw from the contract concluded with the hotel expires two weeks before the contractually agreed date of arrival. Note: According to Directive 2011/83/EU of the European Parliament, Article 16, the 14-day right of withdrawal does not apply to hotel bookings. The cancellation conditions of the hotel apply.

5.

For bookings via online intermediaries (booking.com), the cancellation conditions stored on the booking platform apply.

 

WITHDRAWAL OF THE HOTEL

1.

If it has been agreed in text form that the customer can withdraw from the contract free of charge within a certain period, the hotel is likewise entitled for its part to withdraw from the contract within this period (e.g. failure to make the contractually agreed advance payment). 

2.

In the event of justified rescission by the hotel, the customer shall have no claim to damages.

 

ROOM PROVISION, HANDOVER AND RETURN

1.

The customer does not acquire any claim to the provision of specific rooms unless this has been expressly agreed in writing. 

2.

Booked rooms are available to the customer from 15:00 hours on the agreed day of arrival. The customer has no claim to earlier availability. 

3.

On the agreed day of departure the rooms must be vacated and made available to the hotel by 11:00 a.m. at the latest. After that time, the hotel may charge 50% of the full accommodation price (list price) for use of the room in excess of the contractual time until 3:00 p.m. due to the delayed vacating of the room for use in excess of the contractual time, thereafter 100%.

 

LIABILITY OF THE HOTEL

1.

The hotel is liable for its obligations under the contract. Claims of the customer for damages are excluded. Excluded from this are damages arising from injury to life, body or health if the hotel is responsible for the breach of duty, other damages based on an intentional or grossly negligent breach of duty by the hotel and damages based on an intentional or negligent breach of duties typical of the contract by the hotel. Should disruptions or defects in the services of the hotel occur, the hotel will endeavor to remedy such upon knowledge thereof or upon prompt notification of the customer. The customer is obligated to make all reasonable efforts to remedy the disruption and minimize any possible damage. 

2.

The hotel shall be liable to the customer for items brought in in accordance with the statutory provisions. Accordingly, liability is limited to one hundred times the room rate, but not more than € 3,500 and, in deviation from this, for money, securities and valuables not more than € 800. Money, securities and valuables may be stored in the hotel safe up to a maximum value of € 3,500. 

3.

As far as the customer is provided with a parking space in the garage or on a hotel parking lot, also against payment, no safekeeping contract is concluded. The hotel shall not be liable for loss of or damage to motor vehicles, trailers, motorcycles or trailers parked or manoeuvred on the hotel property and their contents, except in cases of intent or gross negligence. 

 

Illness or death of the guest

1.

If a guest falls ill during his stay in the accommodation facility, the hotel will provide medical care at the guest's request. In the event of imminent danger, the Hotel shall arrange for medical care even without the special request of the Guest, in particular if this is necessary and the Guest is not able to do so himself.

2.

As long as the Guest is not in a position to make decisions or the Guest's relatives cannot be contacted, the Hotel shall arrange for medical treatment at the Guest's expense. However, the scope of these care measures shall end at the time when the Guest is able to make decisions or the relatives have been notified of the case of illness.

3.

The Hotel shall be entitled to claim compensation from the Contract Partner and the Guest or, in the event of death, from their legal successors, in particular for the following costs:

a) outstanding medical costs, costs for patient transport, medication and medical aids

b) necessary room disinfection,

(c) linen, bedding and bedding equipment that has become unusable, otherwise for the disinfection or thorough cleaning of all such items

d) Restoration of walls, furnishings, carpets, etc., insofar as these have been contaminated or damaged in connection with the illness or death, 

e) Room rent, if the room was used by the guest, plus any days of unusability of the rooms due to disinfection, evacuation or similar,

f) any other damages incurred by the hotel.

 

FINAL TERMS

1.

Amendments and supplements to the contract or these General Terms and Conditions of Business shall be made in text form. Unilateral changes or additions by the customer are invalid. 

2.

Place of performance and payment is the location of the hotel. 

3.

German law applies. The application of the UN Convention on Contracts for the International Sale of Goods and the conflict of laws or similar is excluded. 

4.

Should individual provisions of these General Terms and Conditions be or become invalid or void, the validity of the remaining provisions shall not be affected. In all other respects the statutory provisions shall apply.

 

GELTUNGSBEREICH

1.

Diese Geschäftsbedingungen gelten für Verträge über die mietweise Überlassung von Hotelzimmern zur Beherbergung und weiteren Leistungen des Hotels (Hotelaufnahmevertrag). 

2.

Die Unter- oder Weitervermietung der überlassenen Zimmer sowie deren Nutzung zu anderen als Beherbergungszwecken bedürfen der vorherigen Zustimmung des Hotels in Textform.

3.

Allgemeine Geschäftsbedingungen des Kunden finden nur Anwendung, wenn dies vorher ausdrücklich in Textform vereinbart wurde.

 

VERTRAGSABSCHLUSS, -PARTNER, VERJÄHRUNG

1.

Dem Hotel steht es frei, die Zimmerbuchung in Textform zu bestätigen. 

2.

Vertragspartner sind das Hotel und der Kunde. Hat ein Dritter für den Kunden bestellt, haftet er dem Hotel gegenüber zusammen mit dem Kunden als Gesamtschuldner. 

3.

Alle Ansprüche gegen das Hotel verjähren grundsätzlich in einem Jahr ab dem gesetzlichen Verjährungsbeginn. Schadensersatzansprüche verjähren in fünf Jahren. Die Verjährungsverkürzungen gelten nicht bei Ansprüchen, die auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung des Hotels beruhen.

 

LEISTUNGEN, PREISE, ZAHLUNG, AUFRECHNUNG

1.

Das Hotel ist verpflichtet, die vom Kunden gebuchten Zimmer bereitzuhalten und die vereinbarten Leistungen zu erbringen. 

2.

Der Kunde ist verpflichtet, die für die Zimmerüberlassung und die von ihm in Anspruch genommenen weiteren Leistungen zu geltenden Preise des Hotels zu zahlen. Dies gilt auch für vom Kunden veranlasste Leistungen und Auslagen des Hotels an Dritte. Die vereinbarten Preise schließen die jeweilige gesetzliche Umsatzsteuer ein. 

3.

Das Hotel kann seine Zustimmung zu einer vom Kunden gewünschten nachträglichen Verringerung der Anzahl der gebuchten Zimmer, der Leistung des Hotels oder der Aufenthaltsdauer des Kunden davon abhängig machen, dass sich der Preis für die Zimmer und/oder für die sonstigen Leistungen des Hotels erhöht. 

4.

Rechnungen des Hotels sind innerhalb 7 Tagen ab Zusendung der Rechnung ohne Abzug zahlbar. Bei Zahlungsverzug ist das Hotel berechtigt ein Pauschalbetrag (Säumniszuschläge, Bearbeitungsgebühr) i. H. v. 25,00 Euro zu erheben.  

5.

Das Hotel ist berechtigt, bei Vertragsschluss vom Kunden eine Vorauszahlung oder Sicherheitsleistung zu verlangen. 

6.

In begründeten Fällen, z.B. Zahlungsrückstand des Kunden, ist das Hotel berechtigt, weitere Leistungen abzulehnen.

 7.

Der Kunde kann nur mit einer unstreitigen oder rechtskräftigen Forderung gegenüber einer Forderung des Hotels aufrechnen oder verrechnen.

 

RÜCKTRITT DES KUNDEN (ABBESTELLUNG, STORNIERUNG und NoShow)

1.

Ein Rücktritt des Kunden von dem mit dem Hotel geschlossenen Vertrag bedarf der Zustimmung des Hotels in Textform. Erfolgt diese nicht, so ist der vereinbarte Preis aus dem Vertrag auch dann zu zahlen, wenn der Kunde vertragliche Leistungen nicht in Anspruch nimmt. 

2.

Ein kostenfreies Rücktrittsrecht für den Kunden besteht bis 14 Tage vor der Anreise. Innerhalb dieser Frist ist eine Zahlung in Höhe von 50% des Buchungspreises zu entrichten, innerhalb der letzten 7 Tage vor Anreise in Höhe von 75% des Buchungspreises, innerhalb der letzten 24 Stunden vor Anreise in Höhe von 100% des Buchungspreises.

3.

Bei vom Kunden nicht in Anspruch genommenen Zimmern hat das Hotel die Einnahmen aus anderweitiger Vermietung dieser Zimmer anzurechnen. Werden die Zimmer nicht anderweitig vermietet, so kann das Hotel die vertraglich vereinbarte Vergütung zu 100% in Rechnung stellen. 

4.

Ein Anrecht auf Rücktritt von dem mit dem Hotel geschlossenen Vertrag erlischt ab zwei Wochen vor dem vertraglich geregelten Anreisetag. Hinweis: Gemäß Richtlinie 2011/83/EU des europäischen Parlaments, Artikel 16 gilt das 14-tägige Rücktrittsrecht nicht für Hotelbuchungen. Es gelten die Stornobedingungen des Hotels.

5.

Bei Buchungen über Onlinevermittler (booking.com) gelten die auf der Buchungsplattform hinterlegten Stornobedingungen.

 

RÜCKTRITT DES HOTELS

1.

Sofern in Textform vereinbart wurde, dass der Kunde innerhalb einer bestimmten Frist kostenfrei vom Vertrag zurücktreten kann, ist das Hotel ebenfalls in diesem Zeitraum seinerseits berechtigt, vom Vertrag zurückzutreten (z.B. nichteinhalten vertraglich vereinbarter Vorauszahlung). 

2.

Bei berechtigtem Rücktritt des Hotels entsteht kein Anspruch des Kunden auf Schadensersatz.

 

ZIMMERBEREITSTELLUNG, -ÜBERGABE UND -RÜCKGABE

1.

Der Kunde erwirbt keinen Anspruch auf die Bereitstellung bestimmter Zimmer, soweit dieses nicht ausdrücklich in Textform vereinbart wurde. 

2.

Gebuchte Zimmer stehen dem Kunden ab 15:00 Uhr des vereinbarten Anreisetages zur Verfügung. Der Kunde hat keinen Anspruch auf frühere Bereitstellung. 

3.

Am vereinbarten Abreisetag sind die Zimmer dem Hotel spätestens um 11:00 Uhr geräumt zur Verfügung zu stellen. Danach kann das Hotel aufgrund der verspäteten Räumung des Zimmers für dessen vertragsüberschreitende Nutzung bis 15:00 Uhr 50% des vollen Logispreises (Listenpreises) in Rechnung stellen, danach 100%.

 

HAFTUNG DES HOTELS

1.

Das Hotel haftet für seine Verpflichtungen aus dem Vertrag. Ansprüche des Kunden auf Schadensersatz sind ausgeschlossen. Hiervon ausgenommen sind Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit, wenn das Hotel die Pflichtverletzung zu vertreten hat, sonstige Schäden, die auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung des Hotels beruhen und Schäden, die auf einer vorsätzlichen oder fahrlässigen Verletzung von vertragstypischen Pflichten des Hotels beruhen. Sollten Störungen oder Mängel an den Leistungen des Hotels auftreten, wird das Hotel bei Kenntnis oder auf unverzügliche Rüge des Kunden bemüht sein, für Abhilfe zu sorgen. Der Kunde ist verpflichtet, das ihm Zumutbare beizutragen, um die Störung zu beheben und einen möglichen Schaden gering zu halten. 

2.

Für eingebrachte Sachen haftet das Hotel dem Kunden nach den gesetzlichen Bestimmungen. Danach ist die Haftung beschränkt auf das Hundertfache des Zimmerpreises, jedoch höchstens € 3.500,-und abweichend für Geld, Wertpapieren und Kostbarkeiten höchstens bis zu € 800,-. Geld, Wertpapiere und Kostbarkeiten können bis zu einem Höchstwert von € 3.500,- im Hotelsafe aufbewahrt werden. 

3.

Soweit dem Kunden ein Stellplatz in der Garage oder auf einem Hotelparkplatz, auch gegen Entgelt, zur Verfügung gestellt wird, kommt dadurch kein Verwahrungsvertrag zustande. Bei Abhandenkommen oder Beschädigung auf dem Hotelgrundstück abgestellter oder rangierter Kraftfahrzeuge, Anhänger, Motorräder oder Anhänger und deren Inhalte haftet das Hotel nicht, außer bei Vorsatz oder grober Fahrlässigkeit. 

 

Erkrankung oder Tod des Gastes

1.

Erkrankt ein Gast während seines Aufenthaltes im Beherbergungsbetrieb, so wird das Hotel über Wunsch des Gastes für ärztliche Betreuung sorgen. Ist Gefahr in Verzug, wird das Hotel die ärztliche Betreuung auch ohne besonderen Wunsch des Gastes veranlassen, dies insbesondere dann, wenn dies notwendig ist und der Gast hiezu selbst nicht in der Lage ist.

2.

Solange der Gast nicht in der Lage ist, Entscheidungen zu treffen oder die Angehörigen des Gastes nicht kontaktiert werden können, wird das Hotel auf Kosten des Gastes für ärztliche Behandlung sorgen. Der Umfang dieser Sorgemaßnahmen endet jedoch in dem Zeitpunkt, in dem der Gast Entscheidungen treffen kann oder die Angehörigen vom Krankheitsfall benachrichtigt worden sind.

3.

Das Hotel hat gegenüber dem Vertragspartner und dem Gast oder bei Todesfall gegen deren Rechtsnachfolger insbesondere für folgende Kosten Ersatzansprüche:

a) offene Arztkosten, Kosten für Krankentransport, Medikamente und Heilbehelfe

b) notwendig gewordene Raumdesinfektion,

c) unbrauchbar gewordene Wäsche, Bettwäsche und Betteinrichtung, anderenfalls für die Desinfektion oder gründliche Reinigung all dieser Gegenstände,

d) Wiederherstellung von Wänden, Einrichtungsgegenständen, Teppichen usw, soweit diese im Zusammenhang mit der Erkrankung oder den Todesfall verunreinigt oder beschädigt wurden, 

e) Zimmermiete, soweit die Räumlichkeit vom Gast in Anspruch genommen wurde, zuzüglich allfälliger Tage der Unverwendbarkeit der Räume wegen Desinfektion, Räumung o. ä,

f) allfällige sonstige Schäden, die dem Hotel entstehen.

 

SCHLUSSBESTIMMUNGEN

1.

Änderungen und Ergänzungen des Vertrages oder dieser Allgemeinen Geschäftsbedingungen sollen in Textform erfolgen. Einseitige Änderungen oder Ergänzungen durch den Kunden sind unwirksam. 

2.

Erfüllungs- und Zahlungsort ist der Standort des Hotels. 

3.

Es gilt deutsches Recht. Die Anwendung des UN-Kaufrechts und des Kollisionsrechts oder ähnlichem ist ausgeschlossen. 

4.

Sollten einzelne Bestimmungen dieser Allgemeinen Geschäftsbedingungen unwirksam oder nichtig sein oder werden, so wird dadurch die Wirksamkeit der übrigen Bestimmungen nicht berührt. Im Übrigen gelten die gesetzlichen Vorschriften.
